Chris Neilson, a Partner at Mishcon de Reya, spoke with Law360 about the "Mega-Trial" between aircraft lessors and their insurers relating to the claims for the aircraft that remain in Russia. A key issue to be decided in the trial is whether the aircraft can be deemed "lost" in circumstances where they could, in theory at least, at some stage be returned. Chris said, "The court's conclusion on this point will be useful guidance for other situations where an undamaged asset has been wrongly retained and there remains a possibility that the assets will be returned."
