Partner Ben Brandon comments in The Times on how Carlos Ghosn, the former chief executive of Nissan and Renault, was able to escape from Japan to Lebanon. The article examines whether or not Ghosn could feel confident about travelling legally again.
Ben spoke about the reasons a court might find a fugitive would not receive a fair trial, which could include, “…the absence of fundamental procedural rights; widespread discrimination within the criminal justice system of the host state on the basis of gender, race, religion, political opinion or sexual orientation; the lack of an independent judiciary; or the prevalence of political or economic influence over trial outcomes.”
