Navigating telecommunication disputes under the new electronic communications code

Telecommunications disputes arising between operators and property owners have become more prevalent since the new Code came into force in December 2017. With a steady stream of cases coming out of the Tribunal, property owners need clear and concise legal advice on this fast moving area at the earliest opportunity where operators are involved. Failing to consider the Code increases the risk of litigation with telecoms operators and may jeopardise development plans where operators are already on site.

We have specialist expertise in advising property owners in relation to their various interactions with telecoms operators. This includes:

  • advising on transactional matters, including entering into telecoms leases, agreements and wayleaves, and strategic advice pre-acquisition;
  • providing advice around redevelopment projects, including service of notices under the Code, advising on Code procedure such as the interaction with other legislation such as the Landlord and Tenant Act 1954 and disputes regarding the removal of operators’ equipment and planning considerations;
  • undertaking risk assessments and leading on negotiations around the installation or relocation of telecoms apparatus; and
  • acting on disputes relating to access for surveys and the installation and removal of apparatus in the First Tier and Upper Tribunals.
