Daniel Naftalin - Mishcon de Reya

Welcome to the January 2023 edition of Employment Matters: our round-up of the latest developments in employment law and key issues affecting employers and HR professionals.

We start this edition by looking at gender equality. Our Private Team examine the progress made, and distance still to go, in relation to gender diversity in the boardroom. Our Employment Team discuss the workplace-related issues arising from the inquiry of the All-Party Parliamentary Group on the menopause, and my Employment partners, Joanna Blackburn and Susannah Kintish, have produced a podcast in which they analyse the changes in perspectives and behaviours towards workplace sexual harassment in the five years since Alyssa Milano's viral #MeToo tweet.

We then turn to consider more atypical working arrangements. We discuss the pros and cons of engaging a self-employed workforce when building a brand; the government's proposed changes to the flexible working regime; and how the right incentive arrangements can help high net-worth families recruit, reward and retain employees in their family offices. Against a backdrop of record job vacancies in 2022, our Immigration Team also explain the immigration solutions available to employers when looking to fill talent gaps.

Our Incentives team highlights changes being made to the Company Share Options Scheme regime, which are likely to make them much more attractive as an incentivisation tool for employers.

Finally, after last month's World Cup, we couldn’t pass up an opportunity to talk football! Following Cristiano Ronaldo's controversial interview with Piers Morgan, we conclude this Employment Matters by setting out what employers can do if an employee has aired their grievances in public.

As always, if you would like more information on how best to manage these and any other issues in your business, please get in touch with your usual Mishcon de Reya contact or with a member of the Employment team.
