Following the result of last week's general election, which awarded the Conservative Party a landside majority, the country now has a government with a strong mandate to govern. At the very least, and despite Brexit and the implementation of IR35 looming close on the horizon, one would hope that this election result will bring with it the return of some political certainty which has been long awaited in the sector and across the economy as a whole.
As part of their manifestos, all the main parties claimed that they would re-consider the IR35 proposals upon coming to power. Whilst, in our view, we are unlikely to see any substantive changes to the draft legislation, especially with a continuation of a Conservative government, we are beginning to see some guidance from case law as to how the IR35 rules may be interpreted when the legislation does come into force. With Brexit now looking likely to take place by 31 January 2020, our immigration team provide practical advice as to what employers should be doing in respect of any employees that are EU nationals.
Following on from our last edition's article on the use of artificial intelligence in the recruitment sector, in this edition we have examined how virtual reality is playing an equally large role in revolutionising recruitment processes.
Finally, our employment team have written an article on the use of confidentiality provisions in cases of workplace harassment or discrimination. In particular, they consider the potential effect on NDAs going forward, and other significant proposals and measures relating to discrimination that are in the pipeline, including a move to clamp down on repeat offences and the reintroduction of liability on employers for third party harassment.
