Court of Appeal unlocks further Covid-19 business interruption payments from insurers: Chris Neilson for Law360

Chris Neilson, a Partner at Mishcon de Reya, has commented to Law360 on the potential for substantial payments to policyholders following a Court of Appeal ruling on "at the premises" clauses. The decision could have significant financial implications for insurers in Britain, adding to the billions already paid out due to the COVID-19 pandemic. 

Chris commented: "Many of those policyholders may still be waiting to be indemnified for losses resulting from lockdowns which occurred over four years ago. Any policyholders with 'at the premises' clauses should be pushing for payment from insurers." 

The ruling has clarified that policyholders do not need to prove the incidence of the disease at the premises to successfully claim. This development marks a critical juncture in the long-running insurance dispute from the pandemic, with insurers potentially facing hundreds of millions of pounds in additional claims.
