Guy Wilkes, a Partner in our Financial Services Investigations and Enforcement team, has been was quoted in an article in Law360 on the FCA's plans to name companies under investigation.
In this article, Guy expressed his concerns concerned regarding the FCA's new plan and whether it is appropriate for the regulator to disclose the names of companies it is investigating.
Guy said: "We are particularly concerned that the FCA does not seem to deem it necessary to consider the impact on the subject of the investigation when making its decision. In our view, the FCA should only publicize the fact of an investigation where it is proportionate to do so and after weighing public interest arguments against the detrimental impact on the firm and its employees."
