Mishcon Private Partner Filippo Noseda took part to Tax Chat!, a seminar organised by the Center for Taxpayer Rights, a non-profit organisation based in Washington, D.C. dedicated to furthering taxpayers’ awareness of and access to taxpayer rights, to discuss the recent Belgian decision banning FATCA transfers to the US on the basis that such transfers violate basic GDPR rights.
Other speakers included a representative of the U.S. Government Accountability Office (GAO), the immediate past Chief of the IRS’s Criminal Investigation Division and Academics.
Filippo said: "This seminar sends a clear signal to governments on both side of the Atlantic of the increasing awareness on the negative effects of automatic exchange of information. In addition to the Belgian decision, there has been growing media coverage, including in The Telegraph and The Times, concerning the exchange of information with authoritarian countries, something that was also raised by 47 German MPs in 2021."
Mishcon de Reya represents a claimant in a legal challenge against the excessive nature of FATCA before the High Court in London.
