Welcome to the Summer 2023 edition of Brand Matters.
In this edition, we highlight some significant developments including the upcoming deadline in relation to comparable UK trade marks and re-registered designs that were created at the UK Intellectual Property Office on Brexit. From 1 January 2024, a UK address for service will be required where contentious proceedings are brought involving such comparable rights, and it will no longer be possible to rely on an EEA address for service. Failing to provide a UK address for service will run the risk of the action succeeding by default and so, to avoid this risk, we recommend ensuring that a UK address for service is recorded against any UK trade mark or design.
