Nick Davis - Mishcon de Reya

Welcome to the Winter edition of Recruitment Watch, where we delve into the legal issues that are currently shaping the recruitment services sector.

In this edition, we focus on the implications of the new Employment Rights Bill on the Recruitment Services sector, examining some of the key aspects which may impact staffing and recruitment companies.

With AI becoming increasingly integrated into recruitment and employment processes, understanding the implications of harnessing AI is critical. We are pleased to present our latest article exploring the EHRC's updated guidance on the risks of using generative AI in recruitment.  Additionally, we analyse the key data protection issues which stem from the use of AI in recruitment.

We also examine what the recently announced corporate criminal offence: failure to prevent fraud means for employers and recruiters alike. The new offence is due to come into force on 1 September 2025.

Lastly, but definitely not least, we focus on equity incentives, explaining some key aspects that executives should keep in mind to ensure their equity rewards are optimised and not compromised.

If you would like to discuss any of the issues raised, or there is a topic you would like us to cover in one of our future editions, please get in touch with a member of the Recruitment Services team or by contacting us.
