Property Litigation Watch

Editor's note

Daniel Levy, Partner, Head of Real Estate Disputes, Real Estate

Welcome to our latest edition of Property Litigation Watch.

In this issue, we feature articles on a broad range of topics including (amongst others) dilapidations, rights of light, injunctions and data protection.

In our 'Speaker's Corner Q&A', Property Litigation Partner and leading rights of light lawyer Chavvie Kapoor hears from rights of light surveyor Stephen Friel, Chief Commercial Officer & Board Director of GIA.

We feature three articles detailing recent case updates including the Supreme Court's decision in A1 Properties (Sunderland) Ltd v Tudor Studios RTM Company Ltd [2024] UKSC 27, and the case of Anglo International Upholland Ltd -v- Wainwright & Persons Unknown, which provides useful guidance on trespass and injunctions regarding rising drone use.

Finally, our 'On the Horizon' piece considers some of the key reforms and landmark cases expected across the commercial and residential property spheres in 2025.

We hope you enjoy this issue and welcome your feedback. If there is anything in this newsletter that you wish to discuss further, or if you have any ideas for future editions, please don't hesitate to contact any member of our property litigation team here.
