Welcome to our autumn 2024 edition of Brand Matters.
In this issue, we report on some important changes that are about to take place in relation to the design framework in the EU. Alongside the EU reforms, we are also expecting the UK Intellectual Property Office to consult shortly on potential changes to UK design law and practice.
We also continue our focus on green reforms, with a reminder of an upcoming EU law relating to packaging minimisation. In the UK we discuss how the Competition and Markets Authority has issued guidance on how fashion retail businesses should follow its Green Claims Code.
This edition also contains reports on a number of recent interesting trade mark and copyright decisions, including the win for our client, pet insurance business 'Vetsure', against a rival business using the name 'Petsure', in its claim for trade mark infringement and passing off. The Court of Appeal's decision includes a useful reminder of how the courts should approach confusion evidence in such cases.
