The Agenda

Editor's Note

Saul Sender - Mishcon de Reya

In uncertain times for businesses, our September issue of The Agenda highlights both legal developments and wider trends of particular note for company directors. We identify key risk trends for directors and officers and we consider directors' liabilities for wrongful and misfeasant trading in light of a significant Supreme Court decision.

In this issue, we also assess the potential impact of the FCA's new listing regime on the UK's capital raising ecosystem. Continuing our "Families in Business" series, we discuss the challenges of next generation planning for family businesses.

Autumn brings a number of what we hope will be valuable events for our clients. In October, our popular annual In-House Counsel Day will focus on the key issues for in-house counsel to have on their radar this year, and in November our Responsible Business Showcase will offer an opportunity for our clients and partners to explore the work Mishcon is undertaking in its commitment to operating as a responsible business. Please do register your interest in either event.

Finally, we are delighted to welcome to our Corporate Department Anil Arora, who has bolstered the firm's tax offering since joining in June.

A new era for London Listings – Will it present an attractive option at the top of the capital raising ecosystem? What will it mean for sound governance?

The Financial Conduct Authority has announced a new listing regime for London effective from 29 July. Less than a week after she became Chancellor, the FCA quotes Rachel Reeves as saying: "These new rules represent a significant first step towards reinvigorating our capital markets, bringing the UK in line with international counterparts and ensuring we attract the most innovative companies to list here."
